1. Who I Am

This Privacy Policy explains how Sandy Tracks Academy, a business name of Gavin Fleay, ABN 15 340 368 188 (I, me, my), collects, uses, stores and discloses your personal information.

I handle your personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

By using my website, buying a Product, subscribing to my emails or joining my community, you agree to the practices described here.

2. What Information I Collect

What you give me directly:

  • Name
  • Email address
  • Phone or mobile number, where you provide it
  • Billing address and country
  • Payment details, processed by my payment provider. I do not see or store your full card number
  • Your social media handles, niche and business details, where you provide them in an application or onboarding form
  • Anything you submit in a booking form, survey, assessment or community post
  • Messages you send me on WhatsApp
  • Recordings and transcripts of onboarding or coaching calls, where you have been told and have agreed

What is collected automatically:

  • IP address and approximate location
  • Browser and device type
  • Pages visited, time spent and links clicked
  • Course progress and video watch data
  • Email open and click data
  • Cookies and similar tracking technologies

3. Why I Collect It

I use your personal information to:

  • Deliver the courses, coaching, community and direct access you have bought
  • Process your payment and issue receipts
  • Contact you about your purchase, including reminders and support
  • Send you marketing emails about my products, where you have opted in
  • Improve the courses, the website and my content based on how people use them
  • Meet my legal, tax and record-keeping obligations

You can unsubscribe from marketing emails at any time using the link in any email. That will not stop emails about a Product you have bought.

4. Who I Share It With

I do not sell your personal information. I share it only with service providers who help me run the business:

  • Kajabi — course hosting, checkout, email and community platform (United States)
  • Stripe — payment processing
  • Calendly — booking calls (United States)
  • WhatsApp (Meta) — direct messaging, where your offer includes it
  • Xero — accounting and invoicing
  • Google — file storage and website analytics
  • Meta, TikTok and Google — advertising and audience matching
  • My accountant, bookkeeper or legal advisers where needed

I may also disclose information where the law requires it.

5. Overseas Storage

Several of the providers above store data on servers outside Australia, including in the United States and the European Union. By giving me your information, you agree to it being stored and processed overseas.

I take reasonable steps to use reputable providers with appropriate security practices, but overseas providers may not be bound by the Australian Privacy Principles.

6. Cookies

My website and course platform use cookies to keep you logged in, remember your preferences, measure traffic and, where I advertise, to show relevant ads.

You can turn cookies off in your browser settings, but some parts of the site may stop working properly.

7. Security

I take reasonable steps to protect your personal information from misuse, loss, unauthorised access, change and disclosure, including using reputable platforms, strong passwords and restricted access.

No method of sending or storing information over the internet is completely secure, so I cannot guarantee absolute security.

8. How Long I Keep It

I keep your personal information for as long as you have access to a Product, and after that for as long as I need it to meet my legal and tax obligations — generally seven years for financial records.

When it is no longer needed, I take reasonable steps to destroy or de-identify it.

9. Accessing, Correcting Or Deleting Your Information

You can ask me to:

  • Give you a copy of the personal information I hold about you
  • Correct anything inaccurate or out of date
  • Delete your information, where I am not legally required to keep it

Email [email protected] and I will respond within a reasonable time, generally within 30 days. I may need to confirm your identity first.

Deleting your information will usually mean losing access to your courses and the community.

10. Children

My Products are not intended for people under 18. I do not knowingly collect personal information from children. If you believe a child has given me information, contact me and I will delete it.

11. Complaints

If you believe I have mishandled your personal information, email [email protected] and I will look into it.

If you are not satisfied with my response, you can complain to the Office of the Australian Information Commissioner at oaic.gov.au, or by phone on 1300 363 992.

12. Changes To This Policy

I may update this policy from time to time. The current version is always published on my website with the date it was last updated.
