Terms and Conditions

1. Who I Am

These Terms govern your purchase and use of the courses, coaching, downloadable assets, community and direct-message access (together, the Products) sold by Sandy Tracks Academy, a business name of Gavin Fleay, ABN 15 340 368 188, a sole trader based in Western Australia (I, me, my).

2. Accepting These Terms

• You accept these Terms by ticking the box at checkout and completing your purchase, or by accessing any Product.
• If you do not agree, do not purchase or access the Products.
• You must be at least 18 to purchase. If you are under 18, a parent or guardian must purchase on your behalf and accept these Terms.

3. What You Get

• Each offer includes only the Products listed on its sales page at the time you buy. The sales page forms part of these Terms.
• Anything not listed, such as extra one-on-one coaching, is not included and may cost extra.
• Where a Product is sold before it is finished (for example a course marked "coming soon"), I will add it to your library at no extra cost when it is released. I aim to release it by November 2027 at the latest. If I cannot deliver it, you may be entitled to a remedy under the Australian Consumer Law.

4. Your Account And Access

• Access is personal to you and cannot be transferred.
• Keep your login private. Do not share your login, password or account with anyone.
• I may suspend or end your access without refund if I reasonably believe you have shared your access, redistributed my content, or otherwise breached these Terms.
• The Products are delivered through third-party platforms, including Kajabi and WhatsApp. I am not responsible for their outages or faults, but I will make reasonable efforts to restore access.

5. How Long You Have Access

• Courses: lifetime access to the course material, for as long as I continue to offer that course.
• Community, WhatsApp access and coaching: for the period stated on the sales page when you buy. These are not lifetime unless the sales page says so.
• If I stop offering a course, I will give you at least 30 days' notice and, where practical, a chance to download the materials.

6. Payment

• Prices are in Australian dollars unless stated otherwise.
• Prices include GST where applicable. Sales to customers outside Australia are GST-free.
• Payments are processed by Kajabi Payments. You may need to accept their terms too. I do not see or store your card details.

7. Payment Plans

• Payment plans are offered only on selected offers, at my discretion. The total paid on a plan may be higher than the upfront price. The total and schedule are shown before you pay.
• By choosing a payment plan, you authorise me to charge each installment to your card on its due date.
• Some parts of an offer are released only after your final installment clears. For example, on the Full Academy Access plan, the Sandy Tracks Method coaching is released once all payments are made.
• If an installment fails, I will try to contact you. If it is not paid within 7 days, I may suspend your access to all Products in that offer until it is paid.
• A payment plan is a commitment to pay the full amount. Stopping payments does not cancel what you owe, except where the Australian Consumer Law says otherwise.

8. Refunds And Cancellation

• The Products are digital and delivered immediately, so I do not offer refunds for change of mind.
• To stop a payment plan or cancel an ongoing inclusion, email me at [email protected].
• Nothing in these Terms limits your rights under the Australian Consumer Law. If a Product is faulty, not as described, or not fit for purpose, you may be entitled to a repair, replacement or refund.

9. Coaching Sessions

• Coaching sessions are booked through the scheduling link provided in your library.
• Sessions must be used within 8 months of purchase. Unused sessions expire after that and are not refunded.
• To reschedule, give at least 24 hours' notice. If you miss a session without notice, it may count as used.
• If I need to cancel, I will offer another time.
• Sessions may be recorded and shared with you for your own use.

10. WhatsApp Direct Access

• Where your offer includes WhatsApp access, you may message me one-on-one about the Products you have bought.
• I aim to reply within 24 hours, but this is a best-effort target, not a guarantee, as I often work in remote areas.
• Access lasts for the period stated on your sales page. After that, I may stop replying or remove you from my contacts.
• Questions about Products you have not bought (for example, coaching topics if you have bought only a course) are outside this service.
• Please do not share my WhatsApp number or link with anyone else.

11. Community

• Where your offer includes community access, you may join The Sandy Tracks Convoy for the period stated on your sales page.
• Live sessions may be recorded and kept in the community for other members to watch.
• Your posts: you keep ownership of the work you share. You give me permission to display it within the community. I will ask before using your work anywhere public, such as my social media or sales pages.
• Only post content you own or have permission to share.

12. Intellectual Property

• All Product content, including videos, written material, templates, presets, LUTs, worksheets and downloads, is my intellectual property or licensed to me, and is protected by copyright.
• "Sandy Tracks Academy" and "The Sandy Tracks Method" are my brand names.
• I give you a limited, personal, non-exclusive, non-transferable licence to use the content for your own learning and content creation.
• You may use downloadable assets, such as LUTs and presets, in your own published content including paid client and brand work. You may not share, resell or redistribute the assets themselves.
• You must not copy, resell, sublicense, publish, screen-record, upload to file-sharing sites, or use the content to build a competing course or training product.
• If you breach this section, I may end your access without refund and take any other legal action available to me.

13. Your Conduct

• Be respectful and lawful in the community, on WhatsApp and in coaching.
• I may remove you from the community or WhatsApp, without refunding those parts, for abusive, harassing, spamming or self-promotional behaviour.

14. General Information Only

The Products are educational. Nothing I share is financial, legal, tax, insurance or safety advice. Get your own professional advice before acting on anything in those areas, including brand contracts and pricing.

15. No Guarantee Of Results

• I teach the methods I use in my own business. I do not guarantee any result, including follower growth, engagement, brand deals, income or business success.
• Results depend on your effort, skill, niche, consistency and things outside anyone's control, such as platform algorithms.
• Examples, case studies and figures I share are illustrations, not promises.

16. Safety And Off-Road Activities

• The Products cover filming and creating content in off-road and remote areas, including driving, drone and camera work.
• You are responsible for your own safety, the safety of others, your vehicle and equipment, and for following all laws, land access rules, permits and drone regulations (including CASA rules).
• To the extent permitted by law, I am not liable for any injury, loss or damage arising from your off-road, filming or drone activities.

17. Limitation Of Liability

• To the extent permitted by law, my total liability to you for any claim about the Products is limited to the amount you paid for them.
• I am not liable for indirect or consequential loss, including lost profits, revenue or opportunities.
• Nothing in these Terms excludes or limits rights you have under the Australian Consumer Law that cannot be excluded.

18. Privacy

I handle your personal information under my Privacy Policy, available at sandytracksacademy.com/privacy-policy.

19. Changes, Law And Contact

• I may update these Terms. The version that applies to you is the one published when you bought. I will tell you about material changes by email or on my website.
• These Terms are governed by the laws of Western Australia. You submit to the non-exclusive jurisdiction of its courts.
• If any part of these Terms is unenforceable, the rest still applies.
